OpenToBites Privacy Policy

This Privacy Policy explains how AIK Experiments LLC, doing business as OpenToBites (“OpenToBites,” “we,” “us,” or “our”), collects, uses, shares, stores, and protects information when you access or use the OpenToBites mobile application, website, software, communications, subscriptions, and related services (collectively, the “Service”).

By using the Service, you acknowledge this Privacy Policy and agree that we may collect, use, disclose, transfer, and store information as described below. If you do not agree, do not use the Service.

1. Summary

OpenToBites is a social dining coordination app. We collect information needed to create accounts, display profiles and meal posts, coordinate meal requests, enforce plan limits, process subscriptions through app stores, send notifications, improve the Service, review safety concerns, prevent abuse, and comply with law.

OpenToBites is not intended for users under 18. Do not use the Service if you are under 18.

2. Information We Collect

2.1 Information You Provide Directly

We may collect information you provide when you:

  • create or update an account;
  • sign in through Apple, Google, or another provider;
  • create or edit a profile;
  • upload a profile photo;
  • accept basic safety expectations;
  • create a meal post;
  • request to join a meal;
  • accept, decline, withdraw from, cancel, or dismiss a meal;
  • add host notes or request messages;
  • purchase, restore, or manage a subscription;
  • contact support;
  • submit a report or safety concern;
  • join a website update list; or
  • otherwise communicate with us.

This information may include your first name, email address, profile photo, bio, traveler/local preference, age-range display preference if used, verification information if available, account settings, restaurant links, city, meal time, cuisine, meal style, seat count, notes, request messages, host updates, reports, screenshots, and support messages.

2.2 Account and Authentication Information

We may collect account identifiers, Firebase user ID, authentication provider, email address, display name, Apple or Google sign-in identifiers, login timestamps, and related authentication metadata.

2.3 Profile and Public Display Information

Your profile may include information you provide or choose to display, such as first name, photo, bio, traveler/local preference, age range if enabled, meetup count, and verification status if available.

When you create a meal or request to join a meal, OpenToBites may copy limited public display information into that meal or request as a “public display snapshot.” This may include first name, profile photo, bio, traveler/local preference, age-range display setting, verification status, and meetup count. These snapshots allow other users to see relevant meal context without accessing your full private user account record. Existing snapshots may not update when you later change your profile.

2.4 Meal, Request, and Commitment Information

We collect meal coordination records, including host ID, guest ID, city, scheduled date and time, restaurant link, cuisine, meal style, capacity, accepted count, status, notes, request status, request message, host updates, cancellation or withdrawal records, commitment records, check-in or attendance-related records if used, timestamps, and related metadata.

2.5 Photos and Uploaded Files

If you upload a profile photo or other image, we collect the image, storage path, URL, upload metadata, and related technical information needed to store, display, secure, update, and delete it.

2.6 Reports and Safety Information

If reports or safety concerns are submitted through the app or by contacting us, we may collect the report content, user IDs, meal IDs, request IDs, screenshots, messages, timestamps, device or account information, and related activity needed to investigate, moderate, enforce policies, or comply with law.

2.7 Subscription and Purchase Information

If you purchase, restore, or manage a subscription, we may receive and store subscription-related information from Apple, Google, Firebase, Google Cloud, or other providers, such as platform, product ID, subscription status, expiration date, transaction identifier, original transaction identifier, verification response, and entitlement status.

We do not receive or store your full credit card number or full app store payment credentials.

2.8 Device, Log, and Usage Information

We may automatically collect information about your device and use of the Service, including device type, operating system, app version, language, approximate region, IP address, device identifiers, notification token, crash logs, diagnostics, performance data, feature usage, page or screen views, clicks, timestamps, referring URLs, and other log data.

2.9 Cookies, SDKs, and Similar Technologies

Our website and app may use cookies, local storage, software development kits (SDKs), analytics tools, tracking pixels, web beacons, APIs, scripts, and similar technologies to operate the Service, remember preferences, authenticate users, measure usage, analyze performance, improve features, secure the Service, and support marketing or update signup features.

You can control some cookies through browser settings. Disabling cookies or similar technologies may affect website functionality.

2.10 Information From Third Parties

We may receive information from third parties, including Apple, Google, Firebase, Google Cloud, app stores, authentication providers, analytics providers, crash reporting tools, subscription verification providers, map services, or other service providers. The information received depends on your settings and the third party’s policies.

2.11 Aggregated and De-Identified Information

We may create or use aggregated, anonymized, or de-identified information that cannot reasonably identify you. We may use and share this information for analytics, research, operations, improvement, and business purposes.

3. How We Use Information

We use information to:

  • provide, operate, and maintain OpenToBites;
  • create, authenticate, and manage accounts;
  • route users through onboarding, profile creation, and basic safety acceptance;
  • display meal posts, host information, guest information, and request status;
  • create and manage public display snapshots;
  • coordinate meal creation, requests, acceptance, decline, withdrawal, cancellation, and host updates;
  • enforce Free and Pro plan limits;
  • process, verify, restore, and manage subscriptions and entitlements;
  • send push notifications and service communications;
  • provide customer support;
  • process account deletion or privacy requests;
  • review reports and safety concerns;
  • moderate content and enforce Terms;
  • detect, prevent, and respond to fraud, spam, abuse, security incidents, and unauthorized activity;
  • debug, test, analyze, and improve the Service;
  • maintain logs, backups, and business records;
  • comply with legal obligations and lawful requests;
  • protect the rights, safety, and property of users, OpenToBites, AIK Experiments LLC, and others; and
  • send updates, promotional communications, or launch information where permitted.

4. What Other Users Can See

Depending on how you use the Service, other users may see:

  • your first name;
  • your profile photo;
  • your bio or brief profile details if displayed;
  • your traveler/local preference;
  • age range if you choose to display it;
  • meetup count;
  • verification status if available;
  • meal city, scheduled time, restaurant link, cuisine, meal style, seat count, notes, status, and host updates;
  • your join request message if you send one to a host;
  • request status where relevant; and
  • public display snapshots associated with meals or requests.

Do not include sensitive information in your profile, photos, meal notes, restaurant links, request messages, host updates, or other user-visible areas.

5. How We Share Information

We may share information:

5.1 With Other Users

We share limited information with other users as needed to operate meal coordination features, including profile snapshots, meal details, request details, host updates, and relevant statuses.

5.2 With Service Providers

We share information with vendors and service providers that help us operate, host, store, secure, authenticate, analyze, notify, debug, process subscriptions, verify purchases, provide support, or improve the Service. These may include Firebase, Google Cloud, Firebase Authentication, Firestore, Firebase Storage, Firebase Cloud Messaging, Firebase Analytics, Apple, Google, app stores, crash reporting tools, and related providers.

5.3 With App Stores and Payment Providers

If you purchase or restore a subscription, information may be shared with Apple, Google, or related providers to process purchases, verify entitlements, manage renewals, prevent fraud, and handle billing or refunds.

5.4 With Law Enforcement or Legal Recipients

We may disclose information if we believe disclosure is required or permitted by law, subpoena, court order, legal process, regulatory request, or government request. We may also disclose information in emergencies if we believe doing so is necessary to prevent death, serious physical harm, fraud, abuse, or threats to safety, rights, or property.

5.5 For Safety, Security, and Enforcement

We may disclose information where necessary to investigate or enforce our Terms, protect users, prevent abuse, detect security incidents, respond to reports, or protect the rights and safety of OpenToBites, AIK Experiments LLC, users, or others.

5.6 Business Transfers

We may share or transfer information in connection with a merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar transaction. We will seek to require that transferred information remain subject to privacy protections consistent with this Policy or applicable law.

5.7 With Your Consent

We may share information with your consent or at your direction.

5.8 Aggregated or De-Identified Data

We may share aggregated, anonymized, or de-identified information that does not reasonably identify you.

6. We Do Not Sell Personal Information in the Traditional Sense

We do not sell your personal information for money. If future advertising, analytics, or tracking practices are considered a “sale,” “sharing,” or “targeted advertising” under applicable privacy laws, we will update this Policy and provide required rights or choices.

7. Third-Party Services

The Service may link to or integrate with third-party services such as Apple, Google, Firebase, Google Cloud, map services, restaurants, app stores, authentication providers, analytics tools, and websites.

Third parties have their own terms and privacy policies. We are not responsible for their content, practices, policies, security, or availability. Review third-party policies before providing information to them.

8. Notifications

If you enable notifications, we may collect and store device notification tokens and send service-related notifications such as request updates, meal status changes, host notes, reminders, account notices, and safety or security messages.

You can usually disable notifications through your device settings. Disabling notifications may affect your ability to receive timely meal updates.

9. Marketing and Promotional Communications

If you sign up for updates or consent to receive promotional communications, we may send launch updates, app availability information, city updates, product news, or promotional messages. You may opt out by following unsubscribe instructions where provided or by contacting admin@opentobites.com. We may still send non-promotional account, legal, security, subscription, or service communications.

10. Data Retention

We retain information for as long as reasonably necessary to provide the Service, maintain your account, comply with law, resolve disputes, enforce agreements, support safety and moderation, prevent fraud or abuse, maintain backups, support subscriptions, and fulfill legitimate business purposes.

After account deletion, some information may be deleted, anonymized, restricted, or retained depending on the nature of the data and our legal, safety, security, backup, subscription, fraud-prevention, or business needs. Safety reports, enforcement records, transaction records, logs, and legal records may be retained longer where appropriate.

Backups may retain information for a limited period before deletion cycles complete.

11. Account Deletion and Correction

You may delete your account through the app where available or request deletion by contacting admin@opentobites.com. You may also update certain profile information in the app.

We may need to verify your identity before processing deletion, access, correction, or other privacy requests. Deleting your account may not automatically cancel subscriptions purchased through Apple or Google. You must manage app store subscriptions through the applicable app store.

12. Security

We use reasonable administrative, technical, and organizational measures designed to protect information, including authentication, access controls, cloud security tools, storage protections, and monitoring where appropriate.

No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you should not expect that information will always remain private or secure. You are responsible for securing your account and device.

If we learn of a security incident affecting your information, we may notify you or authorities as required by law.

13. Children and Age Restrictions

OpenToBites is intended only for users who are at least 18 years old. We do not knowingly collect personal information from anyone under 18. If we learn that a person under 18 has provided information or created an account, we may delete or restrict the account and related information.

14. International Users

We are based in the United States, and information may be processed and stored in the United States or other countries where we or our service providers operate. These countries may have different data protection laws than where you live. By using the Service, you understand that your information may be transferred to and processed in the United States and other locations.

15. Legal Bases for Processing

Where required by law, we rely on one or more legal bases to process personal information, including:

  • your consent;
  • performance of a contract with you;
  • compliance with legal obligations;
  • protection of vital interests;
  • our legitimate interests, such as operating, securing, improving, analyzing, and enforcing the Service; and
  • the legitimate interests of users and others in safety, fraud prevention, and dispute resolution.

16. Your Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, restrict, object to, withdraw consent, or receive a portable copy of certain personal information. You may also have rights to opt out of certain processing such as targeted advertising, sale, or sharing where applicable.

To exercise rights, contact admin@opentobites.com. We may verify your identity and may deny or limit requests where permitted by law, including where information is needed for safety, fraud prevention, legal compliance, dispute resolution, security, subscriptions, or legitimate business purposes.

17. GDPR / EEA / UK Privacy Rights

If you are located in the European Economic Area, United Kingdom, or another jurisdiction with similar rights, you may have the right to:

  • access personal information;
  • correct inaccurate information;
  • request deletion;
  • restrict processing;
  • object to processing based on legitimate interests or direct marketing;
  • request data portability;
  • withdraw consent where processing is based on consent; and
  • complain to a supervisory authority.

We will respond to valid requests as required by applicable law.

18. California Privacy Rights

California residents may have rights under California privacy laws, including rights to know, access, correct, delete, and opt out of certain sharing or sale of personal information where applicable.

California Civil Code Section 1798.83 may allow California residents to request information about disclosures of personal information to third parties for direct marketing purposes. To make a request, contact admin@opentobites.com.

19. Nevada Privacy Rights

We do not sell covered information for monetary consideration as defined under Nevada law. Nevada residents may submit requests regarding sale opt-out rights by contacting admin@opentobites.com.

20. Do Not Track

Some browsers send “Do Not Track” signals. There is no uniform industry standard for responding to these signals, and we do not currently respond to them. You may control cookies through browser settings and platform-level privacy controls where available.

21. Cookies and Website Controls

You can control cookies through your browser settings. If you reject cookies, some website features may not function properly. Third-party analytics or service providers may have their own opt-out mechanisms.

22. App Store, Device, and Platform Controls

Your device, Apple, Google, operating system, or browser may provide privacy controls for notifications, analytics, advertising identifiers, app permissions, photos, and tracking. Your choices may affect how the Service functions.

23. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Updates will be posted in the app, on the website, or otherwise made available. If changes are material, we may provide additional notice. Your continued use of the Service after an updated Privacy Policy becomes effective means you acknowledge the updated Policy.
